What does the 2022 land registry reform consist of?

The 2022 land registry reform is a topic that has recently aroused much controversy and attention, but full clarity has not yet been made on what will change with this intervention by the Italian government. First of all, it should be clarified that the 2022 land registry reform is based on Article 6 of the tax delegation, which consists above all of a series of general guidelines, which will then have to be concretized by specific legislative decrees, which currently do not yet exist. Trying to summarize the objectives pursued by the government with this reform, it is necessary to place at the center the complete digitization of the cadastre, aimed at bringing out the so-called “ghost” land and properties, or illegal properties (those not stacked today would amount to about 1,2 million), intended for various uses or not registered, building land stacked as agricultural and, in general, all existing irregularities relating to the classification of properties in Italy. This operation, made possible thanks to new models and technological instruments, should serve to make the circulation of documents between the municipal offices and the Agenzia delle Entrate more immediate and efficient. Once this first phase of data and information collection will be completed, the 2022 land registry reform will then aim to provide for the correct classification of all those situations that will emerge as irregular.

That is, as soon as the identification phase of the “ghost” properties will be completed, it is expected to be able to evaluate them correctly: all the properties that no longer have the original characteristics could change category, therefore undergoing changes in terms of taxation. This second phase should begin with the entry into force of the same. Theme that introduces another point on which to clarify, namely the timing of this land registry reform: when will it come into force? To date, the forecasts refer to 1st January 2026, therefore within four years. In fact, starting from 2026 it is expected that the data collected by the Agenzia delle Entrate can be used for the creation of a new cadastral system, which should assign to each real estate unit an asset value and a discounted annuity in line with the market values. The value of the properties for tax purposes, according to forecasts, should be based on a new subdivision into areas or census zones of the Municipalities, in addition to the indication of the area of ​​residential area in square meters and the subdivision of the properties into ordinary and special. Prime Minister Draghi assured that the 2022 land registry reform will not modify the taxation relating to real estate in any way, nor will it introduce new taxes. Furthermore, the government document makes no mention of an increase in the IMU, much less a reintroduction of the IMU on the first home. But certainly something will change.

What will change for luxury property owners?

Before discovering what changes for luxury properties with the 2022 land registry reform, it is appropriate to specify, as already explained in more detail in our dedicated article, that the legislation that defines the characteristics of luxury houses is the Ministerial Decree of 2 August 1969, issued pursuant to and for the purposes of law no. 408, and subsequent amendments and additions, of the law 2 February 1960, n. 35, and subsequent amendments and additions, of the decree-law 11 December 1967, n. 1150, converted into the law of 7 February 1968. This document precisely defines eight categories of houses considered luxury based on various criteria, including the surface area in square meters, the presence of tennis courts or a swimming pool larger than a certain size (as already noted in our other article), the value of the area on which the property was built and so on. Furthermore, even the presence of five or more characteristics present in the “Table of characteristics (point 8 of the Ministerial Decree of 2 August 1969)” means that a property is considered luxury.

Based on these criteria, three cadastral categories relating to this type of houses have been defined: category A/1 of “Stately homes”, category A/8 of “Homes in villas” and cadastral category A/9, which includes “Castles, eminent palaces”. What will change for luxury properties with the 2022 cadastral reform? As noted, the government's purpose is first of all to eliminate inequalities in the cadastre and bring them into line with the real value of land and buildings, but this will certainly also have an impact on the taxes that owners will have to pay who already have properties correctly registered and pay regularly. IMU rates will probably have to be lowered to avoid a huge increase in taxes, while the new values ​​and the revision of the estimates could shorten the list of taxpayers who will be exempt, given that the definition of luxury property on certain homes could change and lead to to include more houses than today.

What will change with respect to taxation and tax breaks for luxury homes?

Therefore, at the level of taxation, it is possible to conclude that nothing should change for those who own properties that already fall within the cadastral categories A/1, A/8 and A/9, therefore luxury houses. The owners of luxury properties, in fact, cannot take advantage of the tax benefits that are guaranteed for all other houses that do not fall into this type. First of all, the registration tax title to be paid is equal to 9% (instead of 2%) of the property's cadastral value. Furthermore, when a house is defined as luxury, it cannot receive the concessions that normally belong to a first home and not even the concessions on houses given on loan for use to children or parents who withdraw a reduction of 50% of the IMU and TASI, excluded for luxury houses.

What could change, however, is the “transformation” into luxury properties for some houses that currently are not, with the consequent cancellation of the tax breaks just described. From an initial analysis of the possible impact of the 2022 land registry reform, it is expected that the legislation could affect as many as 39 million individuals and 1,5 million legal persons, including entities, companies and associations, which could see an increase or decrease, according to the new classification, taxes on their properties. However, not before 2026.

In fact, the G Train is expected to be almost 400 meters long, but above all to be clad externally by 3.500 square meters of latest generation smart technical glass, with an innovative technology that will allow the external structure to transform from transparent to opaque and also become gold or black, and then light up at night. In short, a real jewel of technology and elegance, reminiscent of another train, the Orient Express, about which we wrote concerning the "La Dolce Vita" project. Unlike the Orient Express, however, the G-Train will be able to reach higher speeds which, despite its length, should reach 160 kilometers per hour, thanks to four custom-made locomotives able to adapt to both American and European railways and Asian. In short, a jewel on rails ideal for taking a real tour of the world.

The incredible interiors of the G Train

Moving from the technical specifications of the G Train to the interiors of this futuristic luxury train, we can say that the 14 carriages that make it up will transport travelers into a parallel reality. Yes, because it will be possible to change the interiors by pressing a simple button. A few examples? In case of rain outside, it will be possible to be surrounded by a sunny seascape or by a forest in the middle of spring. In other words, “someone who is aware of the uniqueness of this train and understands that we are not just talking about transport”, in the words of Gauguin himself. And it is completely understandable, also considering that this incredible means of transport will certainly not be affordable to anyone.
